The confiscation of firearms follows a court order. There should be penalties for officials who fail to enforce it. And if someone who has been red-flagged commits a crime using a gun that wasn't confiscated that sheriff is an accessory to the crime.

Watched a segment on this on 60 minutes..20 counties have established "2nd Amendment sanctuary counties" as protest against Red Flag laws..
