Yes, emulation itself is not illegal, just the distribution of ROMs. (Not sure about the legality of owning them for personal use.)

Emulation isn’t dead, but after Nintendo’s lawyers threatened a few ROM sites many ROM sites closed down or removed all their ROMs. This has made obtaining new / additional ROMs which both work and are free of malware, viruses etc. more difficult. Unless of course new ‘safe’ ROM sites (that I am not aware of) have appeared to fill the void left by the demise of Emuparadise and Co.
