They have no authority to control the census. They are going to try to come up with a better argument than the last one. If they had a better one they would have used it. They new they were in trouble going in because of all of the info coming out before they went to court the last time. We will see.

Maybe. Trump is saying he's ignoring that and directing the Commerce Department to include the question.
“The News Reports about the Department of Commerce dropping its quest to put the Citizenship Question on the Census is incorrect or, to state it differently, FAKE!” Mr. Trump wrote Wednesday on Twitter. “We are absolutely moving forward, as we must, because of the importance of the answer to this question.”
Maybe it will end up being just talk. But if he directs them to include the question, and they indeed include the question, then serious legal questions will entangle both the president and those who follow his orders.
Justice Department just declared they will include the question per Trump's orders. I included the link above in my main post (breaking news as of 20 minutes ago).

He can sure try. Then anyone who carries out his illegal acts can be indicted and prosecuted. Of course, that would put himself in legal jeopardy also. (This was avoided many, many times by people who simply refused to carry out his illegal orders, or said they would and didn't--in which case he forgot about it. The Mueller Report is a riveting read.)

Given how understaffed the department in charge of getting the census out they really do not need this bullshit. ross is very aware the needs of this department yet he throws a monkey wrench in the works by trying to get this last minute change in. he lied about why the question was needed, the got caught and the court said so.
