Yes they are lying yet their lies are aimed at a person or group of people.The lies are intended to damage the reputation of the victim(s). In the case of the bible itself this is limited to your neighbors and as such anyone you don't consider a neighbor is exempted from the prohibition so many of the stories in the bible are not violations after all...
