@273kelvin He did not alter the chain of command, he revolked the authority for a more junior officer to act on his behalf. This is a normal act during periods of increased tensions and has been done on countless occations at multiple levels. It is not only normal and permissable for the chairman to contact foreign leaders, it is routine. The calls are transcripted, recorded and listened to by numerous others. It has been black letter law since the Nuremberg trials that if you follow an illegal order, you are guilty of whatever crimes are committed and that it is no defense to say you were following orders. The launch of a nuclear device without provocation violates US law. The president does not have that authority. The chain of command goes President-chairman of the JCS, then down from there. He insured that no one went outside the chain as could be allowed in some circumstances.

He actually followed the law, After the Nixon presidentcy, when it was determined that under the protocol in effect, the Joint Chiefs would be 15 minutes too late to stop an illegal order and prevent a nuclear war. The process was changed to add the JCS command post as an action center. The chairman in normal times delegates the authority to a lower level 2 star or above general, however that delegation of authority was recended by Milley and he dictated that any launch order had to pass through him directly. The president has numerous launch options, a full SIOP (all weapons) if the US has been launched on, multiple limited nuclear options not in direct response to a nuclear attack but justified by other actions. LNOs must be approved by a joint committee under the war powers act. The JCS has the knowledge, equipment and personnel to determine the likelyhood of a foreign launch within 4 minutes of launch and would have been the ones to tell the president. Had Trump ordered an LNO, to provoke the Chinese into a nuclear war, that would have been an illegal order that General Milley rightfully should override and inform the leaders of congress immediately,

@racocn8 Our post WW II intell was that they were close, but that the program was going full speed. they had gotten the breeder reactor tech from the germans. they were in the process of fueling it when the war ended, it would have been at least 6 months after that before they had enough plutonium for weapons. In fact we were 6months away from having our 4th weapon since we had used all our plutonium on fat man and trinity. That is not to say they were only 6 months from a workable atomic device, that is to say they were at least 6 months from having enough fissile material to test one.
