The Democrats completely botched the impeachment. They should have included a bribery charge. The letter released by the White House summarizing Trump's "perfect conversation" was incontrovertible evidence of bribery as found in the US Codes. There was nowhere for the Republicans to hide on it. Nor could they argue that it was not an impeachable offense since the Constitution clearly lists it as such. Between that and the way Pelosi gave away the store on the original stimulus bill, color me extremely unimpressed with her "leadership."

I did a little research on Judge Brann. Although he was appointed by Obama, it was at the recommendation of Republican Senator Pat Toomey. Brann earned his law degree at Notre Dame and is a past member of the Federalist Society and the NRA. In other words he is *maybe* one or two degrees this side of Amy Coney Barrett. For someone with his background to so soundly excoriate Trump's attorneys their case would have almost had to be intentionally bad.

I would go for this on the condition that the states follow through with prosecution. The pardon should be overly broad, to preclude any federal prosecution, but also mention specific crimes including tax fraud, money laundering, and kidnapping. By accepting the pardon Trump will admit guilt, and that admission can be used against him in state courts (e.g., tax fraud and money laundering in NY, and kidnapping in in California or any other state where immigrant children were taken from their parents with no intent of reuniting them). If Trump were smart (in other words, no worry it will happen), he would cut a deal to plead guilty to a federal crime and spend a year in Club Fed in exchange for no state prosecution.

With all due respect, a populist candidate could have beaten Trump this time as well as four years ago. Corporatist Democrats are not what the party needs to win elections. Every Democratic member of Congress who ran on Medicare for All or single payer health care won re-election. The DNC gave us Trump and, without COVID, would have given him to us for another four years. If Biden governs as the corporatist he is, we can expect Trump or worse (e.g., Tom Cotton with policies as bad as Trump, but with the brains and experience in government to get things done) in four years.

Court fees are paid up front by the Plaintiff (i.e., Trump's attorney's). The current fee is $400. Given that Trump is using the least expensive lawyers available, and having them file cases that are immediately laughed out of court (thereby avoiding further attorneys' fees), I doubt Trump is spending more than $3,000 per case. But he keeps up the charade so he can keep fleecing his followers who contribute to his legal fund. BTW, unlike campaign contributions, which have serious restrictions on how they can be used, any left over money in the legal fund can (and probably will) go straight in to Don the Con's pocket.
Pretty sure this is the checklist they're using.

Biden has three choices that I see: 1.) Let McConnell roll over him like Obama did. This will probably end up with the Democrats losing control of the House in two years, and losing more seats in the Senate. 2.) Call McConnell out when he refuses to hold hearings and votes on Biden's cabinet nominees. Explain to McConnell either privately or (my preference) very publicly, that such obstruction is absolutely grounds for declaring McConnell an enemy combatant with all of the rights and privileges appertaining thereto (i.e., retirement complete with room and board at Guantanamo). This would come with the clarification that it was Biden's responsibility as "the Executive" (Article II Section 1) to see that the government functions. He would not be telling anyone how to vote, merely that their job was to hold hearings and vote. He is only doing his job to make sure they do theirs. 3.) Have a private conversation with McConnell explaining that if he doesn't play nice the Republicans in the Senate will be investigated for briberu in relation to their votes on the Trump impeachment.
