@glennlab, than you for your research on this. This is absolute proof that Pence can be prosecuted. However, the prosecution of the President is a very different matter. Article 2, Section 1, Clause 1 of the Constitution says, "The executive Power shall be vested in a President of the United States of America." With a single exception, prosecution of criminal charges is an act of the executive. Hence the DoJ policy that a sitting President cannot be indicted for a federal crime. Of course the single exception is impeachment which is an act of the legislature, not the executive. It is also worth noting that the President is not the executive acting to prosecute state crimes. I am not aware of any valid legal argument that a sitting President cannot be indicted and tried for state crimes.

He had the standard list including health care, education, jobs, immigration, gun violence, etc. I said that, while I agreed that the items on the list deserved attention, I thought the most important item was probably not even on his radar. I think the single most important thing that Congress should try to do is to reinstate the fairness doctrine.
