@glennlab, than you for your research on this. This is absolute proof that Pence can be prosecuted. However, the prosecution of the President is a very different matter. Article 2, Section 1, Clause 1 of the Constitution says, "The executive Power shall be vested in a President of the United States of America." With a single exception, prosecution of criminal charges is an act of the executive. Hence the DoJ policy that a sitting President cannot be indicted for a federal crime. Of course the single exception is impeachment which is an act of the legislature, not the executive. It is also worth noting that the President is not the executive acting to prosecute state crimes. I am not aware of any valid legal argument that a sitting President cannot be indicted and tried for state crimes.

I recently replied to a poll taken by my U.S. Representative about the most important issue we need to address. He had the standard list including health care, education, jobs, immigration, gun violence, etc. I said that, while I agreed that the items on the list deserved attention, I thought the most important item was probably not even on his radar. I think the single most important thing that Congress should try to do is to reinstate the fairness doctrine. Many people I have known for years, if not decades, and that I know to be fundamentally good people, are impossible to have a reasonable conversation with because they are working from a completely different set of "facts". That means the new speaker will probably be a Republican, but this is where it gets interesting. The Republicans may well not be able to get 218 votes for any one person. The Democrats could actually nominate a moderate Republican that they could work with. With 24 Republicans voting with them, they could choose the next President. I would really it rather be a moderate Republican instead of Hillary. Hillary is far to divisive a figure and our country needs healing, not further division.
