As of 6:30 pm PST the undecided states are (with EC votes): 3 Alaska 16 Georgia 6 Nevada 15 North Carolina 20 Pennsylvania Arizona, Maine, Michigan, and Wisconsin have been called for Biden. Ironically, the only state that Trump can afford to lose is the one he will certainly win, Alaska. Biden has 264 EC votes, so any of the states other than Alaska will put him at 270 or more. It looks like Nevada will go for Biden and that will be 270. According to the NYT, based on the trend in mail in ballots and the number of mail in ballots to be counted, Biden could win Pennsylvania by 100,000 votes. That would be 290. Either Georgia or North Carolina could put him overt 300, and he could possibly get to 321. In any case, I expect Biden will get at least 285 EC votes. Combine that with the fact that Biden leads in the popular vote by over three and a half million, and the results are pretty clear.

Biden needs to have six justices vetted and ready for nomination the day after he is sworn in. The Democrats in the House and Senate need to pass the bill expanding the court the morning after the inauguration and Biden needs to sign it and submit the nominees that afternoon. Congress can amend the Judiciary Act of 1869 without a Constitutional Amendment, and do so in such a way that no person serves as a Supreme Court Justice for more than a given term. There is nothing in the Constitution that says otherwise.

This was the precedent I cited: Prior to the Judiciary Act of 1869 the Supreme Court Justices actually "rode circuit" serving as Circuit Court Judges as well as Justices. The act created Circuit Court Judges, but stipulated that the chief justice and each of the associate justices had the duty to sit at least one term in the circuit every two years.

The Supreme Court should be abolished because too much power in the hands of partisan hacks who got there because they were willing to break laws to get their people in office and support their corporate donors.

@Mofo1953, it would not take a Constitutional amendment to limit the terms of judges on the Supreme Court. At the end of their term on the court they would simply be rotated to another court. Prior to the Judiciary Act of 1869 the Supreme Court Justices actually "rode circuit" serving as Circuit Court Judges as well as Justices. The act created Circuit Court Judges, but stipulated that the chief justice and each of the associate justices had the duty to sit at least one term in the circuit every two years.
