General question: Is something considered "published" if it's posted here?

Technically, yes. However, if you're worried about what publishers might think, that is variable, but in general they do.

@DaisyMaeNot -- It's not a problem. Short excerpts are fine and providing a site for longer pieces is also fine as long as the larger works are limited in audience and the work is taken down prior to publishing. Here's the issue: A work presented for editorial/critique purposes is not published in the strict sense of the word and as long as there is no access available for the finished work when it goes to a publisher it has not been published previously. If that were the case, one could easily argue that sending out mss to several beta readers represents previous publishing. Post away.

I've heard and read that if it's "searchable" on the Internet, it is legally published. And I KNOW from being a pro photographer, that I must have a signed photo release in order to "publish" a person's photo on the Internet.

@DaisyMaeNot One observation is that Internet postings are becoming largely uncontrollable. After all, copyrights etc. are laws that simply give people the right to sue others for infringement. For example, if I were to publish photos of you without a photo release, you could sue me. But then, what would it cost you? Would the suit be successful? And lastly, how many people would grab that photo and save a copy during the time you were filing your suit? In my own case, I'm driven more by my own ethics than other worries.
