"Once again, the Johnson Amendment is under attack from the Religious Right and we need your help.

The Johnson Amendment is the federal law that keeps all 501☕(3)s, including churches, from endorsing political candidates. If the amendment were overturned, churches would be able to politick from the pulpit while retaining their tax exemption, becoming unregulated super PACs. This would create a new category of “dark money” because churches are financial black holes and are not required to report annual financial returns to the IRS.

This week, House Republican Whip Steve Scalise, R-La., Reps. Jody Hice, R-Ga., and Mike Johnson, R-La., and Sen. James Lankford, R-Okla., announced the reintroduction of the Free Speech Fairness Act, intended to repeal the Johnson Amendment.

As one of your constituents, I urge you to vigorously defend and stop these ruinous unfounded attacks upon the Johnson Amendment.
This Crucial protection has recently come under attack once again!

Voters such as myself are overtly aware that removing the Johnson Amendment would bring unprecedented amounts of overt non- transparent dark money into the political process!
Which brings monies which will be considered paid out from illicit sources.
Your complete opposition to any legislation that includes any form of rolling back the Johnson Amendment, is paramount which including the reintroduced (and misnamed) "Free Speech Fairness Act" which can be considered to be an a terrorist criminal act against the separation of church and state afforded under the Johnson Amendment!

Americans do not want the overtly wealthy using churches as conduits to pour dark money which can not be distinguished from money laundering by terrorist groups or criminal organizations into political campaigns by wholly unregulated means.

I am personally asking that you protect the Johnson amendment, by protecting it wholly.

These false Claims that it inhibits free speech are a form of terrorist and criminal distraction.

The Joint Committee on Taxation estimated that eliminating the Johnson Amendment would cost $2.1 billion or more over a decade because political contributions to churches would be tax-exempt without any real accountability or actual factual transparency!

As a Voter, I see this as an assault on the Johnson Amendment and the US Constitution. this must not happen on your watch.

You as an elected Senator must vote down the Free Speech Fairness Act and eliminate any further assaults on the Johnson Amendment.

Dear me:

Thank you for contacting me regarding the Johnson Amendment, which prohibits certain organizations from engaging in some political activities. I appreciate having the benefit of your comments on this important issue.

I share your concerns that the IRS and other government agencies may be intruding on the First Amendment rights of churches and other houses of worship across Texas through enforcement of the so-called “Johnson Amendment.” As you know, churches and other houses of worship may be designated as a 501☕(3) organization under the Federal Tax Code. This designation provides tax-exempt status to the organization, which, allows taxpayers to deduct their contributions to them.

The Johnson Amendment has become a burden for churches and houses of worship, casting doubt over what can be said during a sermon and what public affairs message religious leaders may make to their membership. It is important to note that the Religious Freedom Restoration Act of 1993 (RFRA; P.L. 103-114) was signed into law by President Clinton after overwhelmingly passing Congress. RFRA prevents the federal government from substantially burdening a person’s exercise of religion in the enforcement of federal and state laws, unless there is a compelling government interest and the government can do so in the least restrictive manner.

Because of my concerns with enforcement of the Johnson Amendment, I sent a letter to the Internal Revenue Service (IRS) and the Department of Justice (DOJ) requesting they review and consider the interaction between the Johnson Amendment, the First Amendment, and RFRA. Further, I asked both agencies to consider immediately suspending enforcement of the Johnson Amendment, including audits and examinations, until a review has been satisfactorily completed.

The First Amendment to the U.S. Constitution states: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof…” Our Founding Fathers recognized that few rights are as fundamental as our religious liberty and freedom of speech. I am a strong advocate of these fundamental rights. I look forward to continuing the ensure the Johnson Amendment does not encroach upon these rights, and will keep your views in mind as I continue to support congressional action to protect religious freedom and freedom of speech in the 116th Congress.
