I am wondering if any legal eagles out there know if the supreme court have the right to challenge the senate should they exonerate Trumpty on the grounds of contempt for there oath of office when at least two Rublican senators have already stated their intent to exonerate regardless of the evidence

Article I, Section 3, Clause 6 of the Constitution declares that “the Senate shall have the sole Power to try all Impeachments.” And when the Senate is sitting “for that Purpose, [senators] shall be on Oath or Affirmation.” hence the rules for impeachment trials in 1986 requiring each senator to affirm or swear to do “impartial justice according to the Constitution and laws.”

If this oath is taken openly and in perjury provable by prior given public statements that has surely got to be contempt and maybe overruled by the supreme court?

I have no idea how a trial is going to proceed here. Or when that may happen.
Pelosi hasn't sent the Articles of Impeachment to the Senate yet.
By the end of today, we might know when that could happen, but, she might
also wait until after the holiday break.

The rules of any trial have yet to be worked out and agreed upon.
McConnell continues to make it clear that he's going to obstruct justice, and
has said that no witnesses will be called to present evidence.

Chief Justice John Roberts would preside over any trial in the Senate.
How he, or anyone else, would respond to any Senator violating their
oath to be an impartial juror, or anyone clearly perjuring themselves,
remains unanswered.
To my knowledge, there are no precedents for this.
And, as we know, Constitutional scholars cannot agree on what the
Constitution says, or what the Founders intended.

If this trial goes forward, I'm sure we're going to see a whole lot of
stuff we've never seen before.

@KKGator thanks

I think it's right that it happened, but I ain't convinced it's going to make much difference. everybody has their heels dug in, on the hill and main street.

All true, but as I replied to @JayOleck38, being only the third US President to have been impeached will follow him for the rest of his life.
He'll never be able to get away from that.
Never.

@KKGator true. at least there's that. but we will have to hear how he was exonerated by the Senate. I'm afraid we're going to hear that a lot. the bad will among Americans is it going to continue. that's the worst part.

@hankster I'm still hoping for a "miracle". LOL
Or he can just be taken out in a body bag.
Whichever.

The senate won't act. Bunch of fucking stooges.

True enough. The Senate republicans are pathetic and vile.
BUT
Being impeached will follow 45 FOREVER, and he fucking HATES that.
It hurts his ego, and as we all know, his ego has it's own zip code.
