About to go battle CPS over my boy. Soon to be ex took him to Colorado. Want to see if I can put criminal charges on her. Wish me luck.

I believe you can make her come back to home state. She can’t take the child out of state without your permission. Best of luck

She pulled some shit and got a 60 day temp full custody. Did it legal. Wasn't informed of the court date. So I wasn't there. She won by defalt. Beat her twice in court already.

Without a written parenting plan, custody order, etc., all she has to say is We Agreed. Orders are important. There is absolutely no need to be divorced to have a parenting plan or custody agreement. Get on it.

@BlueWave she cut all communication off. I've beaten her in court twice. She only won because I wasn't informed about the court. So now it's just a waiting game.I have an ace up my sleeve that no lawer can beat.

Best of luck to you Spag! That’s a horrendous situation to be in...for you and your son. I’m sorry you’re going through that. I went through multiple custody battles with my ex after I gained full custody and now things are pretty smooth except that she has converted to this new age Christian philosophy that god is whatever she thinks it is and she tries to push it on my sons. I’m just counting down the years until they are raised and our contact drops drastically. Anyway, feel free to reach out if you need support. Is the Colorado thing a move or a vacation?

What does your Parenting Plan/Order say out about out-of-state vacations? What about out-of-state moves?

She moved. No plan. Not even divorced yet. Her only reason she moved there is because pot is legal. That's going to burn her in the end.

@Spag84 Yeah, you definitely need an attorney. In most cases, they aren't allowed to move that far away. But, you are in the military, right? That might be in her favor - especially if she has family in Colorado.

More than anything, even while dealing with this, be the best dad you can be. That's what matters in the end.

@Spag84 With regard to her moving there because marijuana use is legal. Unless you can show that her consumption of using a legal substance is adversely affecting her ability to be a good parent, I'd toss that argument because it likely will not be useful leverage.

Individuals don't "put criminal charges" on others. If she has broken the law, your decision is whether to call the police, who in turn decide it's a prosecutable offense to pursue with the district attorney.

I don't want to get the police involved. The only want to put cuffs on people. Only complicate things.

@Spag84 That's the only way "criminal charges" get introduced, so you can check that one off your list of things to do.

That sucks. Why are you battling CPS for something she did? Or is the trip to Colorado separate from the CPS investigation?

Haven't really had a chance to tell my side. So I did. They wouldn't come right out and say it. But indicated to me they may have made a mistake. Just by reading body language facial expressions. The way things were being said. A lot different from the last visit. Giving me info to get him back and trying to find me info about a free attorney.
