HOW TO DISQUALIFY TRUMP FROM HOLDING PUBLIC OFFICE EVER AGAIN?

Options...

OPTION 1 - Could the Article 3 of the 14th Amendment be used to disqualify Trump from office?

There is a consensus of the Senate majority on this
Section 3 of the 14th Amendment could be used to bar Trump from holding federal office in the future, Section 3 bars people who have taken an oath to support the U.S. Constitution from holding federal office if they “engaged in insurrection or rebellion” against the Constitution or have “given aid to the enemies” of the United States. A waiver by a supermajority of Congress can lift the ban.

Only needs a simple majority
Democrats have this. A Section 3 vote would need only a simple majority vote of both houses (not two thirds)

Trump could appeal against Section 3 in courts
Trump could appeal a Section 3 determination by Congress to the courts, where he would have to face detailed questioning in a judicial proceeding

OPTION 2 - Pass a law to disqualify Trump from holding office for life
The law passing only needs a simple majority in both houses. Democrats have this too. Congress could enforce Section 3 by passing a law declaring that anyone sworn to uphold the Constitution who incited, directed or participated in the Jan. 6 Capitol riot engaged in insurrection or rebellion.

OPTION 3 - Pass a non binding sense of the Congress resolution
Congress could also pass non-binding sense-of-Congress resolutions that specify which people lawmakers intend to disqualify from office. Those resolutions could provide guidance to election officials and judges applying the law after investigations are complete and more facts are known.

More people will challenge Trump's candidacy in courts
Even if Congress doesn’t act, it’s very likely that someone will ask a court to declare Trump ineligible for office if he runs again for president.

More financial and criminal lawsuits are in the pipelines and more to come

~ Lincoln Project is asking corporations not to hire any Trump officials because they have lied to American people.
~ Think Tanks, activists and Lincoln Project are contacting donors and corporations to stop funds to Republican candidates, campaigns, think tanks and PACs who had anything to do with the Capitol Riot on January 6th.
~ The Defense Secretary has begun a strong effort to remove extremists from armed forces.
~ New York AG and Southern District of New York (SDNY) are close to issuing charges against Trump, Trump Organization and family for lying on taxes, compliance and other things to people of New York.
~ The acting US AG has asked for resignations from Trump appointed federal attorneys except for the ones who are conducting inquiries against Trump.
~ Many federal judges have resigned giving Biden a chance to fill moderate and progressive judges.
~ Other states, progressive think tanks, Bloomberg and private citizens are preparing to suck more blood from Trump that will bankrupt him.
~ A class action suit by the rioters and families of the ones off who dies and were hurt is coming.

The majority of scholars agree that using Section 3 of the 14th Amendment is a good idea... sooner than later.
