Well, by definition EVERYONE has rights by virtue of being a human being. That's why they're called human rights. Governments often curtail and limit those rights in practice, but they still exist.

Yes that's true. Essentially in any system Rights are only as sound that the class and power structure that people live under. These things underpin Rights, though they shouldn't, and if the power structure changes, these Rights are at risk, like what is happening in the US now.

George Carlin used to say that Rights that can be taken away are not Rights at all but temporary privileges given and taken by power at their whim.

I knew we were screwed when Bush II talked about "the privilege of freedom of speech."
