Should a President of the United States who is under criminal investigation be allowed to appoint the judges who might rule on his case?

As a Brit, I am amazed that the executive gets to own the judiciary anyway in the US. It's a huge weakness in The Constitution. We even have a better system of checks and balances ourselves, and we just evolved out of a feudal monarchy.
