Should children be constitutionally protected from a specified list of abuses including indoctrination into a religion prior to the age of consent?

It is my opinion that the US Constitution needs to be scrapped and replaced with one based on secular humanist and democratic socialist ideals. The current Constitution is nearly 250 years old , has seldom been amended, and is based on ideals of the "Age of Enlightenment" from the 18th century. Conservative "strict constructionists" want to interpret it literally while liberal "loose constructionists" strain to make it relevant to issues never dreamed of by the founding fathers. Many issues important today are left unaddressed. Among these are women's rights, immigration, gender identity, sexual orientation, animals' rights and children. The modern view is to take custody of children away from biological parent or guardians in the event of "abuse." But what constitutes abuse? Certainly willful failure to provide sustenance and neglect. But what about beatings? The spankings approved by virtually all parents just 50 years ago could land parents in prison today. Though in the 18th century religious instruction would never have been thought of as abuse I believe the tide is turning in another direction. Should children be constitutionally protected from religious indoctrination prior to the age of consent? Should "home schooled" children be required to attend secular public schools, as well? Should private schools fall under the jurisdiction of and supervision by public school boards?

I agree religious freedom, should include freedom from religion. Children have the right to choose their gender now, so why can't they be free to choose their own religion or at least not have one thrust upon them.

Constitutional change does seem to be needed. How could it be brought about? :-\

Revolution. I don't mean armed conflict but enough people saying, "I want my government back!" The entire 230 yr. old Constitution needs to be scrapped and rewritten. A Constitutional Convention should be called by social democrats and secular humanists. A new Constitution should be drafted that eliminates private/corporate money in elections by making all campaigns publicly funded. The rights of all sentient beings from domesticated animals to women and children should be addressed along with a host of other issues like gun control (Nobody needs a gun!) to gerrymandering. Eliminate the Electoral College and replace it with a popular vote. Etc., etc., etc. Once a Constitution is drafted demand it be adopted by the current government and if they don't it is time for lighted torches, pitchforks and a guillotine erected on the Washington Mall!

Seems to me that 'enough people' might be a sticking point.

In my opinion as a Practicing Child and Youth Crisis Counsellor, teaching young children ( aged from 4 thru to teens especially) IS a form of Psychological Child Abuse.
I have counselled numerous children and young people who have been subjected this form of abuse not only on the home front but also at schools as well and the harm done to their minds, let alone their self-esteem, is often well beyond imagination.
Religion and it's dogmas BELONGS solely in the places of Religion and DEFINITELY NOT in places of Education.
IF parents want to be religious then let them be so, BUT, also they MUST be legally TOLD that as parents they MUST allow their children to grow and develop their own minds, understandings, etc, WITHOUT the continuous pressures exerted on them from Religions and Religious Beliefs.

Many of the failings of parents come down to having had poor family background themselves, lack of education and being in a socially restrictive community.
I think the key to most of this is poverty as money buys good health care and education, contraception is used more frequently and women have kids later the better educated and the better their work prospects. They have less children as well.

@Garebare517 I heard a podcast the other day, unfortunately can't remember name of it but the episode is called Watchtower. It detailed a current court case whereby a lawyer for an abuse victim is trying to get 30 odd years of Jehovah's witnesses child abuse reports in a certain state and they have refused and the court imposed a $ million fine followed by $4000 a day fine because they then published a redacted version with the names of the actual abusers blacked out so useless for the guy's case.
Apparently when abuse was reported the emphasis was on counselling the abuser and saving face for the church.
It's sick that a charity is allowed to flout the law by paying court fines using parishioners' money.

It should be illegal to teach religions to children..if when older they want to participate it's their choice..but to brainwash them young unfortunately is the current AGENDA

Short answer: Yes, it should be considered abuse, but... since we can't force people to pass a 'fitting parent or at least human' test before having children... i think maybe we should work on our cultural ideas about what a family is, because that shit is FUCKED up.

I've seen way too many people spend their whole lives in fear of their family's judgement and repeatedly hurting and chastising themselves just for the sake of appearances, or stuck with their wife or husband that they hate for the rest of their lives. Our family structure is terrible, and our entire nation gives NO shits about it. Pro-birth/Anti-life, fucking idiots.

Ask any gay man living with a wife for cover just how fucked up it really is! Two lives destroyed (plus children) just to conform to some idiotic religious left over.

I'm not sure that we shouldn't be teaching parenting skills in schools tbh. Relationship skills as well. Many many people don't have a standard family structure any more and we fill kids' ears and eyes with esoteric knowledge but don't teach them how to cook or do basic first aid or about the law!?

Yes, nobody should have the power to force something so controversial and intimate on to anyone let alone, a child. I recall a course I took in grad school on the sociology of religion or something along that realm. It was discussed that there was a discussion amongst the APA that the new DSM-V would include “Religious Fanatacism” as a mental illness. It didn’t ultimately happen but, it is encouraging that there was even the discussion. I am a mental health therapist. Some of the most disturbed individuals I have worked with are ill because of the religious practices, beliefs inflicted upon them.

I am very interested to learn that the APA even considered "Religious Fanaticism" as a mental illness. Given the ever increasing pace of religiously inspired violence and terrorist acts I wonder if the issue has been revisited and on what grounds such a mental health designation was rejected. I wonder, too, if there is a way to lobby the APA and bring pressure to bear on them to recognize such a designation. I think the non-theist community and, especially those participating on this site, might be united in supporting such a lobbying effort and help increase our sense of community.

Churches should be similar to bars and clubs, identification required. Religion should also be a part of school curriculum where teachers can only teach the religions that they do not personally hold to be true. Obviously, a non-theist could teach the whole class as non-theism isn't a religion, but rather a lack thereof. The class should also be mandatory for all kids. Honestly, in a land where we are all supposedly equal, why don't we have equal schooling?

I love the comparison of churches to bars and clubs. One sells alcohol and the other snake oil. Both should be restricted substances. The onus should be on churches, just as it is on bars, to keep underage people out. And you are right about education. I would like to see religion taught much as is history or any other subject at as early an age as a student is able to grasp the distinction between fantasy and reality. An overview of religion taught to reflect the effects religion has had on both eastern and western cultures is key to a broader understanding of the world. Ideally, no practicing theist should be allowed closer to children than any other child abuser or schizophrenic delusional without being certified capable of teaching such a class dispassionately and sticking to the facts.

You're absolutely right. The constitution is outdated and a new one written. The educational system should also be scrapped as it's designed to teach kids to conform and not to think critically. It is interesting how that coincides with what religion does.

Indoctrination is indoctrination whether it is religious or secular. Both religious institutions and schools are maintained for the sole purpose of churning out little cogs with all the rough edges filed away to conform and fit into the socio-economic machine of the day.

This doesn't work broadly, as I've said before in previous responses, what's good for the goose isn't necessarily good for the gander. This idea of religious indoctrination is an antiquated one for two reasons primarily. The fist of which being that we're talking about western civilization, we live in a social atmosphere in the age of the internet where children are constantly exposed to a wide variety of opinions on social issues such as faith and with access to the internet they are free to opine or read about a nearly infinite spectra of ideas on the concepts of theistic and atheistic , as well as the gnostic and agnostic. The second point of principle of is, since you've limited the questions to The United States, while it is true that most cults are legal in the USA cult behavior often is not. It's a sad fact that a bi-product of religious indoctrination can lead to cult behavior but allot of the baggage that comes from that is illegal activity, such as murder, abduction, statutory rape, drug related crimes, child labor, slavery, polygamy and so on. These behaviors are not always mutually exclusive to cults but these kinds of illegal activities that can restrict the freedom of the religiously indoctrinated apply broadly enough that liberty is maintained through law enforcement and adjudication. The question is both moot and a non sequitur.

I agree with what you wrote GareBear, many of our laws are antiquated and need to be changed or done away with altogether.
Unfortunately, the reality is that it's going to be an uphill battle all the way. The far right fundies not only like the way it is now but want our laws to be even more theocratic in nature.
The hypocrites who drill this fear and guilt into their children's heads should be held accountable.

"A journey of a thousand miles must start with the first step..." I would like to see the non-theist community coalesce around one issue. A glaring infraction of the established doctrine of "Separation of Church and State" is references to a deity on or in public buildings, currency, mottos, pledges, oaths of office, etc. Having those systematically removed forever would be of huge symbolic importance and a great place to start. There is no valid argument against it, only the ravings of nativist fundamentalists. And they'll scream bloody murder. Good! Let them.

Child abuse laws also cover mental and emotional abuse in most places, indoctrination of a child is just that. Telling a small child that he is going to burn for ever in hell for not obeying his father and eat his peas is emotional abuse. Telling a kid that t a magic talking snake caused sin and that is why he broke the window and that the only way he can be forgiven is that ask another invisible magic being to forgive him is mental abuse.
It is my opinion that there should be no option but public school for those that can physically or mentally attend school. Such a change would over night cause the low level of funding for it to disappear
School should focus on evidence based teaching that promotes logical and rational thinking while encouraging the kid to think for themselves.

I would love to see religion die and children to be free of being frightened into compliance. I would like to rational thought and behavior to be the norm. If you tole a child that Thor is going to send him to hell, he would laugh at you, but he shivers at the idea of Jesus and the devil competing for his "soul." No people, there is no good in religion. There is not one quality which is unique to religion, that does not exist in philosophy and natural behavior. Religion is a horrific system of abuse, torture, and murder.

spirituality is an innate part of the human condition, when you look at things from a strictly utilitarian perspective you lose all humanity. For example , A man has a pen, ink and paper, the total cost of everything comes to about $11.58 USD, the total cost to replicate 100,000 of these collections of words on paper in binding is about $3 per unit sold. From a utilitarian perspective the words on paper are meaningless the value of the book is measured in the profit. The human condition exists in symbols, metaphor,and the like every letter makes a sound in your mind, which make up words that have assigned meaning and inter and intra personal meaning and value, the words make up sentences that convey ideas that are up to interpretation by the reader, each subjective word making up subjective sentences making up subjective paragraphs informed by facts and life experience, the sum total of which cannot be measured in dollars and cents, this is is the essence of spirit, a reaction from the creation of and the reaction to what most people call 'art' .

NOPE! First, Many animals show emotion, feelings, creativity, appreciation, grief, and love. These are qualities which have evolved within us and can only be manifested in a brain. It is natural and normal. For anyone to diminish this by saying that co opting a religious term which indicates spirituality in the minds of most people, is an insult to who we are. There is NOTHING spiritual about me loving another person, but that makes it no less awesome. It is unscientific, and as I said insulting, to categorize any living creature as a utilitarian machine unless we label them as spiritual. The humanity of a person is who a person with a healthy brain is. To attempt to define it in any terms beyond a natural biological function is just false and plays right into the religious concept that we are a special creation, separate from the animals kingdom. My qualities and abilities as a human animal do not require any attribute or description that reeks of supernatural hocus pocus baggage.
