@anglophone as the saying goes..."one data point does not show a trend...Aaand...ONE BRAIN CELL DOES NOT MAKE A BRAIN"...so to answer your question...YES...it would be cruel and unusual punishment. 
Of course evidence would show otherwise; who needs evidence anymore, not evangelicals.

They’ve been infiltrating our political and legal system for years. We will be a theocratic dictatorship before too long I suppose....
