In the article, the cops found a phone at a broken window. It was id as an exes. Thus, I would think, the actual phone can be used as evidence and fingerprinted by the cops. The cops wanting to open it needs a warrant. Why does the phone need to be opened in such a case is an open question that, if I were a judge, would want to know why. Opening that phone shouldn't be needed.
Phones should need a warrant, even if found at the scene of a crime.

Absolutely not without a search warrant. Same goes for your computer, car, home, and anything else you own including yourself and what you are wearing.

. . . contempt of court could be a never-ending jail sentence. 😛

Not without a court ordered warrant, which should only be for a major felony.
