Breyer obviously thought that the next Senate would be Republican controlled, making confirmation of a new appointee much more difficult.

I think his decision had more to do with Biden's need to boost sagging support from the older black community, and women, for this mid-term to not go against Dems. If we don't hold The Senate, at least, then the nation may be lost. I think it may have been pointed out that POTUS Joe could wait until a Con died (if one died) or an old lib needed to go. This was a political decision, though.

@rainmanjr Probably some of both, each of which was politically based.

  • Plans * to retire is what the CNN headline read? When? The Republicans managed to block an appointee for almost a year, and it's barely over a year from now we're probably going to lose all of Congress...

They have since changed the rules to no longer require a super majority to vote on Judicial appointments.

Now if Trump appointees would retire, the country would be better off.

Maybe while you are dreaming you can dream up a sccenerio where Sotomayor actually knows what she is talking about. She sure didn't when she spoke n Childhood Covid-19 infections and hospitalizations.

Or if we can impeach Thomas over his wife's activism.
