There will be more than one trial. HerrTrump can't subpoena in New York.

It is actually and historically a mind boggling question. At Nuremberg it was only applied to ranking officers, subordinate military personnel were not tried, which created a double standard.

It was also utilized as a general (versus military) form of defense for not fighting:

"Nuremberg defense" in a different sense. He [US General Telford Taylor] applied it not to the defense offered by the Nuremberg defendants but to a justification put forward by those who refused to take part in military action (specifically America's involvement in the Vietnam War) that they believed to be criminal" Wikipedia

Jeremy Hinzman used the "Nuremberg defense" as his part of his defense for deserting from US Military action in Iraq/Afghanistan...citing the fact the UN did not sanction either war. Hinzman was eventually given refugee status in Canada. [en.wikipedia.org]

It is also interesting to note the psychological basis for following orders pretty much rests on Stanley Milgram's famous experiments in the early 1960s which have been replicated multiple times around the world with similar results...only a minority of individual participants refused to obey the most extreme orders given in the experiment, in spite of the (fake) pleas to stop offered by the supposed victims.
