Has anyone ever sued anyone? It sure is a stressful situation. Not looking for any legal advice here, just a little moral support.

Hey everybody, thank everyone for your comments, I really appreciate it. My second court date went well and hopefully it gets to be my last. Little background, this was the appeal for a small claims case I filed against a completely unhinged ex master tenant who repeatedly insulted me in court. She has picked fights with the clerk during both hearings, accused me of having bedbugs and lice, interrupted both myself and the judge during my testimony, and called me a wacko. None of this stuff has anything to do with the case, she just gets off on insulting me in court. At certain points it's literally so ridiculous that it makes me laugh. But, still very disturbing overall. The judge decided in my favor last time and the clerk mentioned that they very rarely turn over this type of case on appeal.

I find myself handling the stress of it by becoming laser-focused and a bit robotic. San Francisco sure is a trip.

Good news! I'm a legal assistant and three of my four assigned attorneys do primarily appeals.

What is a "master tenant?"

@BlueWave the master tenant is the primary leaseholder in a rental housing unit. If you are a non-millionaire who has just moved to San Francisco for the first time, you will probably not meet the actual landlord yourself, you will have a contract with some master tenant who you pay your rent to and deal with instead.

I had to sue the insurance company of a guy that hit me because they didn't want to pay my doctor bills. I was in the back seat of a Mazda, stopped at a traffic light, and we were re-ended by a GM truck... the driver didn't see the light. I was pretty banged up, but I was ambulatory... SO, the insurance company said that the injuries I suffered to back and spinal chord, were made up. I'll never forget sitting in that courtroom listening to lawyers blaming ME be being hurt... And I'll never forget the arguments about what evidence could be shown, and what couldn't, simply because it involved the insurance company. I swear to Adonis it was one of the weirdest experiences of my life.

crappy insurance company. I had to sue one once for my neighbor's tree falling on my house. All they would keep on saying is act of god. They lost. They even sent a lawyer. Two weeks after that loss the tree dropped another giant limb on another neighbor. The insurance company paid to have it cut down. Especially after the magistrate in my case after seeing the photos told the homeowner she should remove it for the safety of her children. The second neighbor that it fell on was a witness in my case.

@Beowulfsfriend: That's so frustrating. Insurance companies have so much money and it ends up costing them more to fight than it does just to pay for the damage... I'll never be able to understand that.

@Benthoven that is the way of the world now. When I was two, my dad was in a really bad accident. The insurance company for the guy who hit him paid all bills, gave him a paycheck, sent the doctor, barber, etc to the house for the year he was there. Now a days that would have taken a law suit and most likely he could have collected more.

@Beowulfsfriend: Wow... I can't even imagine an insurance company doing that.

Several times and it is always stressful, especially if you are a decent person and not an asshole. I think the assholes of the world love the drama that a legal suit brings with it.

Only in small claims. So, i don't know about a higher level. Won both times. I am not a litigious person by nature, but when i am obviously mistreated I will seek recourse and in both cases i needed to sue. The first case the other party didn't show up. It cost them more as i only wanted the 90 dollars for my broken spedometer not repaired and charged for. They had to return my entire 200 for inspection. And the other was for an insurance company refusing to pay when their client's tree fell in my yard. Again, i only wanted my deductible but got more. That time I went in and did my own lawyer thing against their lawyer. That was slightly exciting. I knew i had won when I went to cite case law and the magistrate said, "Son, if a tree falls in the forest and someone suffers, someone pays."
