The Facts of and the Solution to the Gun Issue, Part I
Our Declaration of Independence establishes the purpose of our government to be enable our people to pursue life, liberty, and the pursuit of happiness, and the U.S. Constitution attempt to provide the intellectual and legal structure which enables our government to establish and maintain the pursuit of that goal. The Constitution is not perfect and no one who was involved in writing that document believed that it was perfect or that it should never be changed in any way. It was simply the best attempt that the founders could get passed by all of the 13 states at that time.

Further, the Constitution attempts to establish the means to build a government designed to provide and sustain the citizens’ pursuit of life, liberty and happiness of well-being. What is to be sustained throughout history is that pursuit, NOT the means of achieving that end. Any thinking person can easily ascertain that as our culture changes over time, and as scientific and technological developments change, it is imperative that the means of achieving or sustaining that pursuit MUST change or the pursuit will be disabled by senseless rigidity of thought

So, any politician or member of the judiciary who professes to believe in an “originalist” point of view on the constitution is either ignorant of history, an intellectual contortionist trying to apply a political ideology to the jurisprudential and/or constitutional process, a person attempting to gain or maintain political power, and/or an outright liar.

So, anyone saying that the Second Amendment establishes the right of any person to own and carry in public of any type of loaded gun it directly attempting to subvert the aim of the Declaration of Rights and of the U.S. Constitution. The uncontrolled ownership and threat of carrying of loaded guns in public is a threat to the life, safety(ergo liberty), and well-being to our people. The limitations to any claimed right must be the extent to which that claimed right impinges on the right to life, liberty and happiness or well-being of others.
Further, any stance of allowing the carrying of loaded guns in public is in direct contradiction to past history. When I was growing up in the 1940s and 50s , it was against the law in most places to openly a loaded gun in public and concealed carry was only legal via permit to people carrying valuable items on a regular basis. It was also against the law to carry a loaded gun in one’s car and would get the offender arrested immediately. Evan the cow towns of the wild west forbade the carrying of guns in public. So, anyone stating the carrying of loaded guns in public has always been allowed is either totally ignorant of relevant history or a damned deliberate liar.

Today, the pushers of guns, including the NRA, the gun manufacturers, and Republican politicians who have sold their souls to get gobs of campaign money say that the problem is not the proliferation of guns, but mental health. But the facts are that in past history, going back to colonial times, there have always been psychotic people, some who were aggressive, those who do not handle their emotions well, and those under extreme stress. Yes some did murder others with guns or other weapons. But, never before in our history have we ever had such a high incidence of gun violence and mass murder by guns. The only differences are the proliferation of guns – particularly semiautomatic pistols and assault rifles and of high capacity magazines. and states encouraging the carrying of guns in public through legislation.

There is no 'originalist' point of view from something written over 250 or even 2,000 years ago. Anyone who claims to do so is a fool and no higher office position should even consider electing such a fool. Languages change and everything is open to interpretation.

The CU I work for took over the NRA credit card line from FNB. I can usually tell within a few seconds when I'm speaking with an NRA member. They have an attitude that I can pick up on most of the time. I can check easily to confirm. I sure hope it was profitable for the company, I prefer to stay far away from any NRA members. Not all of them are awful, but I'd say it is over 50% in my experience.
