Science and art. All of it is built upon the shoulders of prior generations and people. What is the line between an 'original' piece of work and one that is copied? Led Zepplin's "Stairway to Heaven" versus Spirit's "Taurus". I'm familiar with 'Stairway' but had to listen to 'Taurus'. There is a similarity to the opening sequence of both songs, but it diverges from there. Did one of Zep's crew hear it, forget it, and then used it; or down-right steal it, and does a phrase of music constitute plagiarism? That was up to the courts to decide. Using a piece of music that no longer has an active copyright for one's own use -- plagiarism, maybe; legal, yes.
