Some here may recall the famous case of Doctor Hawley Harvey Crippen, executed in 1910 for the murder of his wife in cold blood.
His name is still a synonym for murderer, though he insisted to the moment he was dropped and hanged by the neck that he was innocent.

decedents of the Crippen family are still fighting for a posthumous pardon for their ancestor, however until such time as one is granted in the eyes of history and the law the interred remains of an innocent man remain in unhallowed ground and the man himself is still a convicted murderer with no right of appeal, because of course he is dead, a life cut short in punishment for a crime he definitely did not commit.
This is why no matter how "Obvious" it is that some one is guilty of a crime state sanctioned execution is never a suitable punishment, as it is neither a punishment nor is it Justice, it is a public act revenge.
I agree but today with DNA testing and ballistics testing they have more proof. The shooter was seen by people and identified by the police and victims. Different in a mass shooting. Same with Boston bomber who will be tried - videotape evidence and poliice identification.

I am not in favor of the death penalty. It does nothing to deter the most violent of crimes. It costs a fortune in tax payer money with all the appeals ans such.
Better to work on educating, solving the racial divide and income in equality. Too many dis enfranchised angry white men in this country.
In general I do not believe a government should kill any if its citizens. That said, the question asks about if the shooting is a hate crime - yes, I believe so and thus the death penalty can be put in the table. There are some people who just don't deserve to be on the earth and would be better gone.
