TITLE 18, U.S.C., SECTION 242

"Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, ... shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death."

Trump conspired to deprive 81 million Americans of their right to have their votes count in the 2020 election. That is what the fake elector scheme was designed to do.

The scheme hinged on Mike Pence using the fake electors in the joint session of Congress as a pretext to stop the lawful certification of the election according to the Electoral Count Act.

The mob attack on the Capitol that Trump incited was in furtherance of the conspiracy. Trump used the mob to pressure Pence into recognizing the fake electors and preventing Congress' lawful certification of the 2020 election under the Electoral Count Act.

The attack on the Capitol resulted in wrongful death(s).

Ashley Babbitt would not have broken into the Speaker's Lobby, and would not have been fatally shot if Trump had not incited his supporters to attack the Capitol on January 6, 2021.

Officer Brian Sicknick suffered two strokes and died a day after being beaten for hours by Trump's mob.

For two months, Trump had riled up his supporters with lies about a stolen election. Then he called them to DC ("Be there! Will be wild!" ), explicitly instructed them to march on the Capitol, and then tweeted, "Mike Pence did not have the courage to do what should have been done..."

Therefore, under Title 18, U.S.C., Section 242, Donald J. Trump should face life in prison or the death penalty. IMHO. Trump himself is very fond of firing squads...

This should happen but it will not. Reasons are seen in my area by the combo Confed/American flags that fly. People might do an uprising that would cause unwanted death. I admit that these flag- flyers are not going to win, but the government is afraid of what might happen.

As well they should be. The problem is that there are so many of the deluded bastards. Tens of millions! We will just have to let the facts come out in court, and hope this sways a few. Even so, house arrest may be the best we can hope for.

One of the problems is that the DOJ has decided not to pursue charges they (believe they) can't prove. Thus, while Trump committed numerous felonies in plain sight, he remains unindicted on those charges because within the protocols of a courtroom, conviction could be in doubt.

The DOJ SHOULD be charging him ANYWAY. And they should have charged him with Obstruction as laid out in the Mueller probe. The DOJ HAS been weaponized, but not by the Democrats. When you hear that, it's actually the Republicans crowing that THEY'VE corrupted the DOJ. It is always projection...

Trump has been charged with violation of 18, U.S.C., Section 242. All that remains is for a jury to see the links, connect the dots, and convict the Done Cheato. I know this is asking a lot...😂

I think death penalty would make him a martyr. Life in prison won't likely be very long, but once his platform is gone he should fade into oblivion.

I fear that MAGA could outlive him, but at least we can show them that there are consequences for treason.

So should every US President who during term of office has seen innocent people incarcerated in gaol. Let's start with those incarcerated in Guantanamo Bay & tortured. How many presidents does that include?

I have always maintained that George W. Bush is a war criminal. But his is not the case addressed in this post.

@Flyingsaucesir why limit the scope of your enquiry. Isn't it a case that the law applies equally to all not just those not favoured by you because of their political affiliations, gender or nationality?

@Flyingsaucesir what emergency? The only emergency is that created by your incumbent, Trump, Obama & those before them. It's called the US proxy war in Ukraine together with attempt to impose US hegemony, piracy, bullying, subservience, slavery & colonialism on the rest of world.
