Well, attended the Local Court on Tuesday for the Hearing of the Case re- Belinda v. Catholic Priest, School Principal and her Parents.
About 10 minutes after the Court was called in to Session, it was adjourned for 30 minutes because Justice 'X' took exception to the Priest, who was Detained in Custody, NOT given strict Home Detention, was wearing his clerical garb instead of the 'jumpsuit' provided by the Department of Corrections.
Justice 'X' ordered that the Priest be removed from the Court and made to change in to the CORRECT Apparel or face a charge of Contempt of Court.
40 minutes later, with the Priest in the 'jumpsuit' Court resumed and through his Lawyer the Priest expressed that " He IS a representative of God and his Priestly Garb is HIS RIGHT to wear."
Justice 'X' banged down the gavel, looked at the Priest and said, quietly, " Well where exactly was this God of yours when this heinous crime was occurring, why is it that your God is NOT sitting on this Bench beside me and rendering his justice as well?"
She went to say, " In this Court of Law I am the Representative of the Laws of this country, I follow the Protocols as per laid down by the Laws of this country and SHALL NOT be dissuaded or persuaded by Religion nor Religious Laws, etc, etc."
The Court went silent for about 5 minutes, then the Charges were read out and, to our complete surprise, ALL 4 Defendants pleaded Guilty but requested consideration and leniency from the Court.
To which came the reply from Justice 'X' " What consideration or leniency did YOU show to the Plaintiff/Victim in this case, I have read thoroughly the Prosecutions reports, the statements from the Plaintiff and witnesses and I see absolutely NO sign of any leniency or consideration for the Victim."
I shall hear, shortly, from the Plaintiff, etc, the emotional and mental torment, stresses, etc, that she has been through in the last few weeks PLUS what she had suffer and endure for the last 5 plus years of her 13 and a half years of life, then I shall adjourn this court until tomorrow (Wednesday) when I shall pass my Rulings and Sentences."
1 hour later, court was adjourned, we went with Belinda for a coffee, the Defendants were returned to Custody.
Yesterday, we attended court again.
Justice 'X' handed down her Rulings on the case then pronounced the sentences to each individual Defendant whilst making absolutely certain that EVERYONE could hear them and that there would be NOT consideration/s nor leniency.
Maximum sentences were given, 7 years each with parole ONLY to considered AFTER serving 6 years and 8 months, the Defendants WILL NOT have any further contact, etc, with the plaintiff in the future and doing so WILL result in further charges being brought against them.
A stern and strong recommendation to be SENT directly to the Church that the Priest be dis-robed immediately, the School Principal be de-registered and banned for LIFE from teaching, etc, and that ANY claim/s for Victims of Crime Compensation made by the Plaintiff be fast-tracked and the amounts paid be NO less than $5,000 per month for EVERY month the Plaintiff has suffered and endure plus accrued interests that would have been earned in those periods of time.
And finally that ALL Defendants, now Convicted Criminals SHALL serve their sentences in prisons NOT in the Broken Region or Gaol BUT in the General Prison Populations.
For once REAL justice has been served.

What is the ethnicity of the child victim?

Does the case set precedent for future cases say against police for mistreatment of First Nations when arrested or targeted?

Well, I can't answer ANY questions regarding the 'Ethnicity,' etc, of Bel.
But IF you read through what Justice 'X' stated you'd see what her stance is on religion and Church being separated in her court/s.
As to your last question, then I assume ONLY time shall tell what result/s come from that.

@Triphid let's hope that it creates the precedent that makes them pause before automatically mistreating First Nations People.

@FrayedBear Hey, I've known many a 'First Nations' people in my years and, technically by heritage am one of them.
Amongst a lot of them there seems to an ethic of sorts that is kind of like " We can do anything we like/see fit BECAUSE WE do NOT come under White Fellas Laws, we are Aboriginals."
Yet, those very same people are the first in line when it comes to reaping the benefits of White Fella Society, etc, etc.
Yes, there ARE the good and decent ones as well and I also know many of them, BUT, the problems DO exist, for example, First Nation children of ALL ages are left to roam the streets at ALL hours day and night, here there are a certain number of families, whose last names I will not mention, with Police records stretching back almost as far as the eye can see, records for crimes such as Theft, Break and Enter, Drug Dealing, Disturbing the Peace, Drunk and Disorderly, Common Assault, Assault Causing G.B.H., Domestic Violence, Motor Vehicle Theft/s, Rape plus a whole lot more.
So when you read about How bad things are for the First Nation Peoples TRY to remember that at LEAST 60% of it IS HYPE put out by the WHITE Do-Gooder Advisers who are making a fortune, literally, from it all and doing almost ZERO to help solve the problem.

@Triphid Lol, I experienced some of it amongst the Djarkinjung on the Central Coast. They dold a parcel of land that was devrloped into a golf resort. About ten years later a NSW minister decided to steal it! The barrister fees were amazing.
The chairman of the land council had to move. None of his fellow aborigines would help him, not even his wife, & teenage children who also lived in the same 4 bedroom house!

@FrayedBear Well, it seems that you haven't experienced the "Rellies" situation that many of the good decent Aboriginal families have to endure then.
The "Rellies" situation is where someone like my Good and Great Friend, Bev, ( a First Nation person btw) gets a house, makes good of herself, and in Bev's case, "adopts," in her own words, "a few stray kids/youths,' and suddenly the relatives(?) all appear from nowhere EXPECTING to be accommodated totally free of charge and for as long as they see fit.
It took ,literally, 3 years of hard talking to actually convince Bev that she should accept the Aged Pension rather than relying upon her ever dwindling finances.
Then another 3+ years to help her rid herself of the 'hangers-on' and get herself into a far smaller, easier to care for Community style Housing Complex where there is ONLY 1 bedroom, a kitchen, Dining area, bathroom, etc, etc, and NO room for the 'hangers-on' any more.
Within a month she was actually pleasantly surprised at and by the amount of her pension that she had left after each fortnight instead of seeing literally eaten up by furnishing meals, etc. for others who were merely' using her.'

@Triphid my grandmother who I think was too mean to die, she did eventually & the family didn't bother to tell me for 6 months, allways used to say "don't make friends if you don't want spongers!"

@FrayedBear Yes BUT in the Aboriginal communities that does NOT actually apply since the ethos there is completely the opposite.

@FrayedBear Yes and no, depending solely upon the circumstances, i.e. in their original nomadic existences it was a good thing since each of the clan/tribe cared for and shared with all others hence facilitating the survival of all, BUT in this modern world, not so good simply because it permits/allows those who choose NOT to become self-supporting, etc, to instead become the 'parasites' of those who have chosen to be self-supportive.
Unfortunately it IS NOT confined ONLY the Aboriginals, it is also VERY prevalent among the Western Cultures as well.

Thanks for posting this, I needed a good judge story after the crap coming out of our U.S. courts.
Oh! How I would love to hear a U.S. judge say what she said to child abusers in America.

Hopefully this powerful defense of her rights will help this young girl to step up and be proud of who she is and what she can achieve. The law sometimes works.

Wearing of clerical garb will get more sympathy than a DOC jumpsuit. This is also why in sexual or murder cases a woman on trial is made up to look like an innocent little girl. The jumpsuit makes everyone equal.

Of course we know money makes all the difference here in the U.S. This case was in Australia, even so more judges like this one are needed.

Well, Belinda was and still is a completely INNOCENT young girl but one can't say the same those low-life scum who brought all of this upon themselves.

I could find no news of this case? When and where did it take place?

As she is a juvenile it would not be reported in order to protect her privacy, at least one hopes people would protect her privacy also the town in small and probably not internet note worthy.

@Budgie Well if this is a story that happened in America the local press would have covered it and it would show up in an internet search. I'm concerned that this isn't a real story. I was hoping this site was immune to misinformation but that was kind of stupid of me.

The Court Hearing, etc, was held as a Closed Hearing for the purposes of Protecting the Privacy and Identity of a Minor/Juvenile, hence ONLY the Defendants, Plaintiff, Supporters for the Plaintiff and Witnesses were permitted to attend.
As her Counselor and Supporter I was also required to attend.
Btw, I CAN legally post certain amounts of information on this Site om the provisos that,

  1. I have her permission in writing,
  2. I do NOT use actual names, etc, and,
  3. I never use this case as source/part source material for a book other than one for educational purposes.

@Budgie Not actually so "small and probably internet noteworthy," we have a population of approx. 19,000 BUT our local Media are somewhat really decent people when it comes to cases such as this thankfully.

Just got off the phone with the Clerk of Justice 'X' who tells me that we, Bel, the Support Group, her new 'family' and I are REQUESTED to be her Guests for Dinner this coming Saturday Evening AND instructed to wear something both casual, respectable and make certain we are hungry as well.
Thank the Stars it is NOT a formal dress type event, I do NOT do formal in any way.

Kudos for the judge. A lot of judges don't like pedophiles - not enough. The school I worked at had two teachers who were partners get caught- 5 male students. They didnt immediately plead guilty and it appeared that they were going to force a trial. The D.A. had given them an offer. Anyway, on their day one in front of the judge, in civis because they were on bail, they threw themselves at the mercy of the court. The Judge have them 3 to 5 years more than the DA's offer. It was still, in my mind, not a big sentence (one guy got 5, took all the required classes and got out in 3; the other guy got 10 and served the whole 10 because he wouldn't admit that he did anything wrong).

I liked the way the Judge straight out REFUSED to consider ANY pleas for leniency, etc, and then in sentencing ORDERED that they do their time IN the General Prison Populations.

She deserves every penny she receives, and then some.
I hope the diosese goes bankrupt AFTER they pay her.

Belinda was quite rightly nervous at first on Tuesday but she overcame that when the Judge ordered the now EX-Priest to be removed from court and MADE change his attire.
We ALMOST had to stop her from cheering out loud.

If I am correct victim of crime money does not come from the criminals but the court purse which is filled with tax payer money and all of those pesky fines people get when driving. I wish the catholic cult were held responsible and made to pay but then she would never see the money.

YAAAAAAAAAAAAAAYYYY!!!!!!!!!!!!!!!!!! A judge who doesn't bow down to religion's laws......FANTASTIC!!!!!!!!!!!!! Very pleased for B, & hopefully she can heal, to have a reasonably good life. So glad she had support through this horrid time.

And, she, the Judge, also spoke to Belinda and our little support group AFTER the session and told us that She was and always will be an Atheist and that Church, State and Law will always remain completely separated in HER Court Room.
I don't know about how the others felt at hearing that BUT my estimation of her grew exponentially at hearing it.

@Triphid I can imagine. I just wish there were more like her in law enforcement.

As of last evening, Belinda's Lawyer is drawing up Claims for Victims Compensation BUT making them individual Claims against EACH Convicted Criminal NOT as a kind of BULK Claim.
By doing this it WILL mean that ALL compensation will be multiplied by a factor of 4 instead of just a single amount.

@Triphid Unfortunately all they have to do is declare bankruptcy and they won't have to pay her. My brother is battling his former employer who owes him 20,000 at least and had not paid his super payments for 2 years and this guy has basically said he will declare bankruptcy before paying. (he has done this before when hit with a pile of debts)

Still battling with the State Rail Authority of N.S.W. over compensation for the damages caused to my throat, lungs and nostrils after rescuing a work-mate from a cloud of leaking Anhydrous Ammonia after the incorrect Safety Valve was fitted to a tanker.
A leak and near disaster that should NEVER have occurred btw.

@FrayedBear Well to the best of my understanding compensation comes from the Victims of Crime Funds initially and the Offenders are forced by law to relinquish monies, etc, to cover costs and compensations.
It appears that Covid may be making life a bit 'tough' for Dealers and Junkies these days.
It is a similar situation as is in use when it comes to arrest and conviction of Drug Dealers and Suppliers where the Police SIEZE ALL assets of those convicted.
Just as they did here last Monday when the BIG Drug Busts occurred, 4 houses raided in quick succession, 5 arrested, approx. 1 million + dollars worth of Meth and pills, etc, and numerous unlicensed firearms a well.
Plus, last weekend, and this IS no joke, a bloke decided to try and 'cover up' the odours emanating from his 'little Crack cooking Enterprise' by burning furniture in his backyard at 4.00am.
The Firies and Police arrived because neighbours lodge complaints about the smoke and found his 'little' kitchen in full swing.

In actual FACT the 'person' in question was of the First Nation, owning a number of Unregistered, Uninsured motor vehicles plus 2 Trail bikes that are presumed to be of 'questionable' ownership, well known to Police but until then NO provable evidence of Drug-Dealing.
Thankfully, our local motorcycle Enthusiasts, i.e. BIKERS NOT Bikies btw, are Law-abiding citizens with only links being to either the Ulysses Motorcycle Club for those over 45 and the local Harley Owners Club BUT NO association with ANY of the Outlaw Bikie Gangs.
Jeez Louise M8, I used to own and ride a few motor cycles in my time, had the first Honda 750cc 4 cylinder ever to arrive in Broken Hill, until some mongrel stole it, then went on to restoring a a B.S.A. single cylinder, 500cc, YB33 model and my last was a 1982 model, Suzuki, 850cc, 4 cylinder, GS, not the GT, touring bike.
Given enough of the spare cash, I'd buy another bike tomorrow ONLY this time it'd be one with a side-car and somewhere around the 500-600cc's in engine size.

@Triphid Unlike my brother who ended up teaching the police to ride motorbikes, I never took to them. He was killed/murdered 20+ years ago by another motorcyclist on the wrong side of the road on a blind corner wearing an illegal black visor at dusk.

@FrayedBear I doubt that it would have been an actual 'murder' since MURDER must have an intent to cause such a thing to happen.
Wearing a tinted visor at dusk is NOT illegal since the tinted visor helps keep the glare of the sunset and other lights from 'blinding' the rider.
Personally I have NEVER worn full-face helmets BUT have always worn either safety style sunglasses or tinted ski goggles when traveling because the on-coming headlights can cause momentary blindness.

@Triphid it is illegal overseas. Manslaughter is more likely the correct word. The perp was merely charged with bad driving & given a suspended licence for three months.
