A 26-year-old woman, Lizelle Herrera, was arrested last Thursday in Starr County, Texas, and charged with murder for allegedly performing a self-induced abortion. The Starr County grand jury's indictment stated that Herrera "did then and there intentionally and knowingly cause the death of an individual J.A.H. by a self-induced abortion."

She was released from jail Saturday after bail was posted on a $500,000 bond. The DA has filed a motion to dismiss.

I'm confused, isn't it the DA that sought the indictment from the Grand Jury in the first place??

Also, the hospital needs to do a thorough assessment to see if they can find out who called the police. That is a severe HIPAA violation and grounds for immediate dismissal and, if a licensed individual, potentially a punishment from their board up to and including the loss of their license.

yeah, well just wait until they start charging women who have miscarrages under the same law. The lady must have done something to cause the miscarrage so guilty she is.

An EXPERT on such matters as Abortions and Miscarriages are you?
May one enquire as where and how you gained you qualifications, etc, etc, to ALLOW yourself to make a comment?
As a retired and well qualified, MALE, yes MALE, Mid-wife I would DEARLY love to hear aboutv your sources of such information and, if it would be NO trouble then PLEASE add in the number of births you have attended and assisted with as well, then we can compare notes perhaps.

@Triphid wtf, the last line was satire dude

@starwatcher-al SATIRE being used in such dire and serious subject/situation, what is next, you posting something satirical about a member suffering through a miscarriage or perhaps you'd like to raise a few a laughs for yourself by disrespecting the child of a member who has just died from either an incurable disease or maybe suicide, imo, I'd lay odds on bets that such a thing may well have you in fits of laughter, at least until, may it never happen, someone near and dear to you dies in such a manner of course.

Update: All charges have been dropped.

I still hope she sues the hospital.

The right wing imbeciles who govern red states pander to the religious right because that will ensure their permanence on power, they don't give a flying fuck about the "children" because once they're born, all help to them is basically gone. This is what religion does and I'm sick of it!

3

If men had to carry and give birth to children, and then become responsible for their welfare, there would be no such absurd and vile anti-abortion laws.

Try saying that to all the evil vicious pro-life fuckwits who are in charge of many states in the USA.

@anglophone ...........this is empty of meaningful content, and your potty mouth makes athiests look bad. try shutting up.

@holdenc98 I'm going to support anglophone on this one. There is a problem with the govenors and senior politicians in authority in many states, and anglophone has a perfect right to express that as he has chosen to do.

In addition to stories about ridiculous criminal charges, we will soon be hearing about a surge in deaths caused by clandestine abortions gone wrong. Wait and see. Sigh.

6

They will dismiss because the charges are too bizarre to be proven. Abbott should be ashamed of himself.

There is no way that Abbott will be ashamed of himself - he is far too arrogant.

@anglophone Every politician has a skeleton or two in the closet. Maybe it's time for the news hounds to do some sniffing.

@anglophone Is it just me or does this Texarse Abbott sound ever so much like an Abbott we Australian know and detest as well?
Nature could NOT have such a wry sense of humour as to burden the Universe with 2 of the same, could it?

@Triphid Oh yes it can, dear boy!

@anglophone Yes, you are right, sad but true you are right, since after all we've Abbott the Rabbit, Turdball and now ScumMo.

Charges have been dropped.

Why were those charges ever laid in the first place?

Answer: It pleased some vile fuckwit to make trouble for somebody else.

@anglophone I would say that "vile fuckwit" would be Gov. Abbott and the entire GOP Texas legislature.

If that be so then if I were in her boots my next step would be to file a suit for Wrongful Arrest and Imprisonment and be naming the Legislature of the State of Texas as co-defendants.

They should never have been made in the first place.
I'm with Triphid, she should sue and make a big stink about this. Women lawyers should be all over this and keeping it in the news and social media for as long as possible. Put the pressure on politicians and take the power away from the religious nuts.

@anglophone Texas Christian Taliban

@ADKSparky Precisely.

7

What else could one expect from such a demented and retarded state as TEXARSE.

7

Welcome to the lunacy of the extreme right wing that infests much of Texass.

8

Unfortunately this is going to get worse.

17

It'll get worse, I'm afraid. Please support Planned Parenthood and/or NARAL!

Interesting...they can't charge her with murder, because abortion is legal in the USA, and the Texas law allowing people to be charged with aidding an abetting abortions, does not allow for the person receiving the abortion to be charged. Wonder why the DA is wanting to drop the charges?? Or so its reported,

It's not clear why she was arrested and charged, because SB8 apparently excludes the person getting an abortion from culpability. Sounds like maybe the hospital was spooked about liability? But it's disturbing anyway - an example of the chilling effect of even false charges or unconstitutional laws. The DA is dropping it because there is no basis.

19

I hope Ms. Herrera sues the hospital for violating her HPPA rights.
This is bullshit.
Fuck Texas.

Outrageous. What right does anyone have to force an unwanted pregnancy on a woman or to dictate what a woman can or can't do with her body.
If they want to play that game then they should arrest men for masturbating. Think of all the potential babies they murder each time they do it. Millions.

"What right does anyone have to force an unwanted pregnancy on a woman or to dictate what a woman can or can't do with her body." Ask just about any evangelical, conservative, republican.

The same right I have to shred their prefrontal cortex.

@jlynn37 At some point it will come back to bite them. Politicians flip flop all the time, they will support what ever the numbers favor. The tide will change.

@racocn8 Are planning upon utilising an electron microscope or a telescopic sight to actully locate, aim and fire the necessary bullet ?
Give the average I.Q. of most Religious Politicians, I would most definitely RECOMMEND using the Electron Microscope since I sincerely doubt that you would get enough magnification and definition by using a standard Telescopic sight system.

What right? Saving a zygot that has a soul at the time of conception is a RELIGIOUS concept. Saving the microscopic dividing cells is more important that caring for neglected children already here. In their narrow minded Catholic view of which dominates the Hispanic vote in Texas, they are voting against their own interests. One issue voters who voted for President You Know Who.

@Mooolah If they put the time, energy, and money into finding solutions for abused, neglected, and unwanted children that are suffering now instead of fighting to punish women for having an abortion. Just think of what they could accomplish.
They care more about unborn babies that the ones suffering that are already here.
